Terms & Conditions KUUN. This version is valid from January 2020.
These terms and conditions are applicable to every offer of KUUN, a brand of the company ZONGA.

Article 1 – Applicability
1.1 Our terms and conditions apply to every offer of KUUN as webshop and to you as a consumer (every natural person that, except for non-professional objectives, buys or uses launched products or services)
1.2 We deliver both national as international
1.3 To place an order with KUUN you must at least be 18 years old. If you are not 18 years old, we kindly ask you to let your parents or legal guarding place the order. If we notice that an order has been placed by a minor, we have the right to refuse this order.
Article 2 – Our offer and your order
2.1 If an offer has a limited duration or is subjected to certain conditions, we will clearly mention this in our offer.
2.2 We always describe what we sell as complete and precise as possible and how the ordering process will develop further. The description is always detailed enough to give you the chance to form a right judgement. We would like to highlight that slight differences and imperfections are to be considered a proof of handmade quality and the unique character and origin of our products. The images we use will always be a truthful represenation of the offered services and/or goods. Making an mistake is on the other hand humane and if we have clearly made a mistake, we are not obliged to offer the product to you.
2.3 Your order is complete and the agreement between us is definitive as soon as we confirm your order by mail and the instant we have received the approval of your payment transaction with credit- or debitcards by the publisher of the card. We accept payments via creditcard or online banking. When the publisher of your card refuses to agree with your payment to us, we cannot be held responable for any delays with the delivery and/or no-delivery of your order. Orders without a valid payment of the registered card holder cannot by accepted or processed
2.4 To purchase a product, you add it to your shopping cart. After that you fill in your contact details and account details. Then, you choose the delivery method: delivery to a certain adress, pick up in a parcel point or in our store. Confirm your order by clicking the button ‘place your order’.
2.5 ICONIC FACORY 76, the owner of the brand KUUN, is authorized to cancel an agreement with belated payments by the customer or problems with payments of previous orders

Artikel 3 Right of withdrawal
3.1 The customer has the right to return the delivered product(s) or part of the delivered product(s) within 14 days without giving any reason. Returning the delivered product(s) is at the expense and risk of the customer. We kindly ask you to put the return form, added with your order, with your return and to fill it in completely. “KUUN design” will make sure to pay the total invoiced amount (excluded shipping costs) to the customer within 14 working days.
3.2 If the customer uses the right of withdrawal, the customer will be held accountable for the costs of returning the products.
3.3 We are authorized to wait with the refund untill we have received the goods back or until you have proven that you have already send the goods back to us?
3.4 During the first 14 days after delivery we kindly ask you to handle the products and packaging with care. If you are planning on returning the goods, as defined above, you may only unpack them or use them so that you can make the judgement whether you want to keep the good or not. Returned goods may be fitted, but cannot be used, the price tag also needs to be adjusted at the item. To return the product(s), they must be in the original packaging (including accessories and related documentation) and be in new condition. If the product(s) has been damaged in any way by the customer, the right to return the product(s) expires.
3.5 You can refund your items with the post or a courier.
Artikel 4 Pricing
4.1 Prices will not be increased during the term of the offer, unless legal measures make this necessary or the manufacturer increases the prices in the mean time.
4.2 Our prices are including VAT, taxes, services and shipping costs. You will never be surprised at the checkout. We can however decide to add shipping costs on top of the purchase price. You will be updated by these costs before placing your order.
Artikel 5 Payment
5.1 We can only accept payment through the methods of payments on our website.
Artikel 6 Conformity and warranty
6.1 KUUN guarantees that the delivered products are in correspondence with your order and require the normal expectations you have from your order, holding into account the specifications of the product. We also guarantee that our goods fulfill the legal rights and law applicable at the moment of your order.
Artikel 7 Delivery
7.1 All goods and services will be delivered on the adress given by the costumer while placing the order. KUUN cannot be held responsable in any way by mistakes made by the customer while submitting the delivery- and/or billing adress and that can lead to delays of the delivery or the impossibility to deliver the ordered products.
7.2 When an article is in stock, it will be delivered on your delivery adress within 14 workdays. These delivery times count as an indication and there are no rights applicable.
7.3 When a product is out of stock, the customer will be notified via e-mail about a later delivery date. When the customer does not agree with the delay, the ordered product can be cancelled or the customer can order an alternative product. The cancelld product will be refunded or, when ordering an alternative product, the remaining amount or the amount due will be refunded or billed.
7.4 If we are not able to deliver within the delivery time, we will notify the customer within the delivery period. If we haven’t done that, you can choose to give up your order without any costs. In that case we will refund you completely within 30 days.
7.5 Our deliveries are out our own risk. You don’t need to worry about goods who go lost in the mail. However, if you return goods within 14 days after the purchase, because you chose not to keep them, you are responsable for the transport.
7.6 When the goods, delivered by us, were damaged during the transport, do not correspond with the ordered items you are obliged to notify this within 3 days and to return the items to us within 14 days after reception. The costs for the refund are for KUUN.
7.7 We cannot be held responsable for any consequential damage caused by delayed delivery or non-delivery of the transport firm that the enterprise has appointed. In such cases, our liability remains limited in such cases to the value of the articles untill proven that the customer hasn’t received them.
Artikel 8 Force majeure
8.1 In case of force majeure, KUUN reserves the right to postpone its obligations and also has the right to cancel the agreement partially or entirely or modify the content of the agreement to make it possible to execute. In no case will KUUN be obliged to pay a fine or compensation.
8.2 The circumstances pertaining to force majeure are all unusual causes and circumstances, which should not belong to Loavies' risks. Delays or non-fulfilment of obligations by suppliers, problems with the internet, electricity failures, problems with email traffic and failures or changes in technology supplied by third parties, problems in transport, strikes, government regulations, delays in supply, negligence of suppliers and/or manufacturers including other assistants, illness of employees and shortcomings in means of transport, …
Artikel 9 Intellectual property
9.1 Our website, logo’s, texts, photo’s, names and our communication overall are protected by the rights of intellectual property that are with us, our suppliers or other persons entitled.
9.2 It is forbidden to use or adjust in the rights of intellectual property as described in this article. All images, photos, drawings, logo’s, color combinations, … cannot be used or copied without our prior consent and written consent.
Artikel 10 Complaints and disputes
10.1 Our main priority is that our customers are 100% satisfied. If you would have any complaints about our services, you can contact us via firstname.lastname@example.org We will take your complaint into account within 7 days.
10.2 On all agreements we close up with our customers, regardless their living place, the Belgian law is applicable and only the Belgium courts are authorized with disputes.
